Why must the State, understood as general will, be distinguished from the State apparatus that oppresses?

Dominique Pagani starts from a distinction worked out with Michel Clouscard: the State and the State apparatus. With Marx criticizing the Gotha Programme and the example of the state forest opposed to private property, he shows that the notion of the State is contradictory: it designates both what increases our freedom and what oppresses us. He proposes to call "State apparatus" the police, the army and the closed circles of power, and to reserve the word "State" for Rousseau's general will, an organic whole opposed to the rule of a part over the whole. He then establishes the paradox of the present: the most powerful State apparatus in history serves the negation of the State, that is, the private. He draws from this the political confusions of the moment (anti-statism credited as left-wing, red-browns, Atlanticist imperialism) and ends with a defense of the universal against everyone's confinement in their culture or their genes.
